1. Do Not Rent From Diane Turton Realtors - Jersey Shore


We were told that beach passes were included in our Point Pleasant Beach rental home, but when we arrived they were not. For a family this was a great additional expense as we had to purchase daily passes (hundreds of dollars total). The rental manager laughed and told me that there was nothing I could do about it and refused to honor his salesperson's promise, even though it was confirmed. The manager was unprofessional and even seemed to take joy in the fact that he 'got away with it'. DO NOT RENT FROM DIANE TURTON REALTORS. There are many reputable agents in the area who may even offer the same property.

2. Unlawful retention of security deposit


Owner, in email exchanges I have retained, repeatedly stated that the cost of the rental was $400 with a $200 pet deposit/fee. He used deposit and fee interchangeably. He always distinguished between the rental cost and the pet deposit. He used the word fee in the rental contract. After the rental period, he refused to return the $200 (I left the apartment in pristine condition), and for the first time stated that the $200 was a non refundable rental fee for the dog.

3. FALSE ADVERTIZING


THE PICTURES HE SHOWS OF THE CONDO ON THIS SITE ARE NICE - THE CONDO WAS FILTHY - DIRT AND MILDEW - OVEN STARTED THE SMOKE ALARM -THIS PLACE WAS NOT CLEANED IN AT LEAST A YEAR - AND I DON'T MEAN THIS YEAR. THE QUEEN BED WAS SUNK IN SO BAD TWO PEOPLE COULD NOT SLEEP IN IT -- TWIN BED SLOPED SO BAD YOU COULD NOT STAY UP TOP - YOU SLIDE HALF WAY DOWN. PILLOWS WERE SO STAINED WE PURCHASED NEW ONES TO USE FOR THE NIGHT. HE OFFERED TO HAVE HIS CLEANING CREW COME BACK - WE REFUSED BECAUSE WE WERE ALL MOVED IN - THE NEXT DAY WE GOT OUT - HE SAID HE WOULD RETURN MY MONEY -- NOW HE WON'T BECAUSE WE WOULDN'T LET HE SEND THE CLEANING CREW IN.

4. Security Deposit not Returned for no Valid Reason


The property was listed for $1,850. We asked if we could get it for less and the owner agreed to come down $150. After we left we found out we wouldn't get our $200 security deposit back. We were shocked because before we left we vacuumed, cleaned the bathrooms, the refrigerator, stove and the microwave. Then, when we were leaving the cleaning crew arrived. Then when we received a report on what was supposedly wrong, we were flabbergasted by the inaccuracy and even ludicrousness of the claims. Here are the charges:

Claim: We left late, holding up the cleaning crew.
Fact: The cleaning crew arrived just as we were leaving.
Claim: Food was left in the refrigerator.
Fact: No food was left in the refrigerator, although two cups of ice cream were left in the freezer.
Claim: We left out dirty dishes and we put dirty dishes in the cabinets.
Fact: All the dishes we put in the cabinets were washed in the dishwasher. The dishes from the day we left were washed and left in the drying rack.
Claim: An open box of sugar cubes was left in a cabinet.
Fact: It was there when we arrived.
Claim: We left a bag of charcoals, indicating we grilled, which violates condo rules.
Fact: We didn't have a grill, didn't grill and didn't bring in a bag of charcoals. If there was a bag of charcoals it was there before we arrived.
Claim: The carpets were stained.
Fact: I vacuumed upstairs, my wife vacuumed downstairs and we didn't observe any stains. And, we never spilled anything on the carpet.
Claim: We broke slats of vertical blinds.
Fact: We didn't break any vertical blinds, and at one point the owner claims the broken slats were in the bedroom, and at another point she claims they were in the kitchen.
Claim: The curtain brackets in the living room were pulled out of the wall in two spots.
Fact: We didn't do anything to the curtain brackets.

It's very obvious that the reason the owner came down $150 in the rental was that she figured she could falsely claim that we left the condo in an unacceptable condition and more than make up the $150.

In addition, shortly after we arrived we had a problem with ants, so we called and they sent an exterminator. Now the owner claims that we were responsible for the ants, and that's one of the reasons we didn't get back the security deposit.

And we were woken up two nights in a row by the smoke alarm. (It stopped after a couple of hours the first night, after I vacuumed it so we thought it was O.K., but it started up again the second night.) We called and they came and replaced the battery. This should be done regularly, not just when it causes a problem. Also, the problem detector was hanging from the ceiling, and not connected to it, so it's apparent that something was amiss with it and was never corrected.

5. Ann Marie Weiss's Rental at 9D Castagnolia


From December 24th to December 27th 2009 we rented this home from Ann Marie Weiss, under the pretense that she is a nice and trustworthy person to rent from. Unfortunately, when the lease came to an end though, these qualities seemed to instantly disappear. We were accused of damages that we had not done, I assume, as a way to steal money from us. Ann Marie and her husband Brian Weiss decided to take advantage of a group of renters that made sure to treat their property just as our own.
Ann Marie accused us of "making the hot tub murky" and went on to deduct $150 from the security deposit to have the water pumped out, despite the fact that while we were there, the hot tub repairman stated that the hot tub has a faulty pump that causes the water to become murky. Now I'm no expert on hot tubs, but I'm not sure it costs $150 to pump out the water, so naturally, before losing $150 on something that may not have been my fault, I asked for an invoice for the work, as well as a statement from the repairman saying that it was indeed our fault. Instead of truthfully determining our fault, Ann Marie and her husband completely ignored us; they did not answer any phone calls, voicemails, or emails. They held our $700 security deposit and refused to talk to us to come to a fair compromise on the matter, despite signing a contract holding them to the return of our money.
Moral of the story? If you see Ann Marie Weiss's rental on Craigslist (where we found her) or any other rental website, BEWARE! To me, it appears that their rental home is just a scheme to STEAL money from innocent people, as they did to me. I write this as a way to protect others from falling into the same trap as I did. Ann Marie Weiss and her husband Brian Weiss appear to be a dishonest, devious, untrustworthy couple that you do not want to rent from, take it from my bad experience.
